Geographical Child Relocations

Under Florida law, a custodial parent moving 50 miles or more away must obtain permission from the other parent or the court before relocating with a child, including filing a formal Notice of Intent to Relocate. The non-custodial parent then has 30 days to object; if no agreement is reached, the court holds a hearing and rules based on the child’s best interest — and in rare cases, a contested relocation can even affect primary custody.
